Terms of Service
[Full Name], known as client, has tendered to Rent in St. Louis, known as Company, the sum of $10.00. Company agrees to accept as payment in full for services described in the contract, receipt of which is hereby acknowledged. Our service provides information on what's available for Rent in St. Louis. These will be rentals that are update and sorted to meet your specifications during the term of your contract. We will process your registration the first business day it is received. You will receive referrals the first day of registration. It is your responsibility to contact the landlords and to check with our office for new rental information either by phone or in person.
Rent in St. Louis assumes no responsibility other than to provide referrals, nor do they assume responsibility for any disagreements between landlord and client or for any claim for damage or loss.
RIGHT TO REFUND
If, within five (5) days after payment of a fee, the company has not supplied the client with at least three available rental properties meeting the specifications (via the internet/website) of the contract as to (i) type of structure; (ii) designated area; (iii) furnished or unfurnished; (iv) number of bedrooms; (v) maximum rental, the full amount of the fee paid shall be refunded to the client upon presentation of evidence of that failure within ten days after the expiration of the five day period. The client is not entitled to a refund if the client obtains a rental through the services of the company.
If the client obtains a rental other than through the referrals of the company during the term of this contract, or if the client does not obtain a rental through the referrals of the company during the term of the contract, the company shall refund the fee received in excess of a ten dollar ($10.00) service charge to the client within ten days after the client supplies either (i) reasonable documentation of the client's new rental or the fact that the client did not move, such as a lease, rental agreement, or utility bill, with sufficient information to verify that the new rental was not obtained through the services of the company or that the client did not move.
To be entitled to a refund in excess of the service charge, the client must mail or deliver the demand for refund not later than 10 days after expiration of this contract, and must supply either (1) reasonable documentation of the client's new rental or of the fact that the client did not move, such as a lease, rental agreement, or utility bill, with sufficient information to verify that the new rental was not obtained through the services of the company or that the client did not move. The documentation may be supplied after the demand for a refund is mailed or delivered, provided that it is supplied within a reasonable time after it becomes available.
This section will not apply to a person who purchases rental information from the company for a purpose other than that of locating a rental unit for personal use or the use of a designated person.
You may bring a small claims court action against the licensee for his/her refusal to make a refund on your demand of all or part of the fee paid by you under this contract. If the court finds that the licensee has acted in bad faith in refusing to make the refund, the court has the authority to award you up to one hundred ($100) in addition to damages actually sustained by you.
The listing information being provided to client pursuant to this contract is considered proprietary and confidential by company. Client agrees that client will use it for the sole purpose of locating a rental unit for personal use and will otherwise keep it confidential and not disclose it to third parties without company's prior written authorization. Company may pursue legal remedies for the unauthorized use or disclosure of listing information provided under this contract.
Company and client do agree that the sum tendered and accepted by company as shown below entitles client to information from company for the period shown below, beginning with the date of payment. Company is open for business Monday - Friday from 10 AM to 4 PM, excluding holidays. Company promises to make available to client all listings (by the method selected by client above) based upon criteria provided as frequently as desired during tenure of this agreement via the website.
The purchase of any goods and services other than the provision of listings of residential real properties for tenancy is optional.
